  • Full name and date of birth.

  • Contact details, including telephone number, email address and postal address.

  • Confirmation of age verification through photographic identification.

  • Relevant health information voluntarily provided through the Client Health Questionnaire.

  • Tattoo design, placement, ink colours, pigment batch numbers and procedure date.

  • Signed consent forms and records relating to the tattoo procedure.

  • Photographs of tattoos, where the client has provided permission.

Photographic identification may be requested to verify age, but copies of identification documents are not routinely retained.

Only information reasonably necessary for professional, administrative and safety purposes is collected.

3. Why Do I Collect This Information?

Personal information is collected and processed for the following purposes:

  • Managing appointments and communicating with clients.

  • Confirming age eligibility for tattoo procedures.

  • Assessing potential health and safety risks before performing a tattoo.

  • Documenting informed consent.

  • Maintaining relevant professional and procedure records.

  • Displaying tattoo photographs in professional portfolios, websites or social media, only with the client’s permission.

4. Legal Basis for Processing Personal Data

Under Article 6 of the GDPR, personal information may be processed on the following legal bases, as applicable:

Contractual Necessity

To arrange appointments, communicate with clients and provide requested tattoo services.

Legal Obligations

Where processing is necessary to comply with applicable legal requirements.

Legitimate Interests

To maintain appropriate professional records, manage business operations and protect legal rights, provided these interests do not override the rights and freedoms of the client.

Consent

Where consent is appropriate, including optional promotional photography and publication.

Special Category Health Data

Health information is classified as special category personal data under Article 9 of the GDPR.

Relevant health information is processed on the basis of the client’s explicit consent under Article 9(2)(a), for the purpose of assessing potential risks associated with tattoo procedures.

Clients may withdraw their consent to this processing at any time. However, where health information is necessary to assess whether a tattoo can be performed safely, withdrawal may prevent the procedure from proceeding.

Where legally applicable, limited information may also be retained for the establishment, exercise or defence of legal claims under Article 9(2)(f).

5. How Is Personal Information Stored and Protected?

Client consultation forms, health questionnaires and signed consent records are maintained exclusively in paper format.

These documents are stored securely, with access restricted to Sue Maistro as the independent tattoo artist and Data Controller.

Paper records are not routinely scanned, digitised or uploaded to online storage services.

Reasonable precautions are taken to protect personal and health information against unauthorised access, disclosure, accidental loss, damage or misuse.

Client information is treated as confidential and is not made available to unauthorised third parties.

6. How Long Is Personal Information Kept?

Personal information is retained only for as long as reasonably necessary for the purposes for which it was collected.

The retention of client consultation forms, health questionnaires and consent records is determined by relevant professional record-keeping needs, applicable legal requirements and the potential establishment, exercise or defence of legal claims.

Records are periodically reviewed to ensure that personal information is not retained longer than necessary.

Where information is no longer required for a legitimate purpose and no lawful basis for continued retention applies, paper records are securely destroyed using appropriate methods to prevent unauthorised access or reconstruction.

7. Photography and Portfolio Use

Photographs of completed tattoos may be taken for professional documentation or portfolio purposes.

Photography and publication are optional and are not conditions of receiving tattoo services.

Photographs will not be published on websites, social media or other promotional platforms without the client’s permission.

Clients may withdraw their consent for promotional use at any time by contacting Sue Maistro.

Following withdrawal, reasonable steps will be taken to discontinue future promotional use and remove relevant content from platforms under the artist’s control, where applicable.

However, content previously downloaded, shared or redistributed by third parties may not be fully recoverable.

8. Sharing Personal Information

Client personal and health information is not routinely shared with third parties.

Information may be disclosed where required by applicable law, where necessary in connection with legal proceedings, or where disclosure is otherwise permitted under applicable data protection legislation.

Where third-party service providers are used for business communications or administrative purposes, appropriate data protection safeguards will be applied as required.

Personal health information is not disclosed for advertising or unrelated commercial purposes.
